The landscape of employment for lawyers in 2024 is marked by significant legal and regulatory changes that will impact various aspects of employment law. Here are some of the key developments:

Non-Compete Agreements:

The Federal Trade Commission (FTC) has proposed a nationwide ban on non-compete agreements. This rule is facing legal challenges, but if implemented, it would significantly alter the landscape for employment contracts, affecting many lawyers who draft and enforce these agreements (Employment Law Worldview).

 

Paid Leave and Wage Transparency:

Several states have introduced new laws regarding paid sick leave and wage transparency. For instance, California has increased the number of job-protected paid leave hours and extended certain protections to employees covered by collective bargaining agreements. Additionally, Colorado has amended its Equal Pay for Equal Work Act to require employers to post job opportunities with salary ranges and benefits information (Littler) (Hopkins & Carley).

 

EEOC’s Proposed

Guidance on Harassment: The Equal Employment Opportunity Commission (EEOC) has published a proposed update to its enforcement guidance on workplace harassment, which has not been updated since 1999. This guidance will clarify legal standards for harassment and employer liability, and if finalized, it will supersede several older documents (National Law Review).
